By placing an order, either written, verbally or via our online checkout process, you are making an offer to purchase goods which, if accepted by us, will result in a binding contract. We may refuse to accept an order where goods are not available or if there has been a pricing error. We reserve the right to reject any order for whatever reason, at any time, in this event we will contact you as soon as possible. Card payments may be debited before the contract is formed, if your order is ultimately rejected, a refund will be made immediately.

All prices indicated are in GB pound sterling. Our prices do not include VAT as we are not at this point in time registered for VAT. The price is also exclusive of any local import taxes/duties/tariffs and such like, that may be levied – these costs are the responsibility of the customer. The total cost of your order is the price of the goods ordered plus the delivery charges as set out in this website. The delivery of oil paintings is by special arrangement and is not included in the price. All prices quoted for artwork exclude framing unless specifically stated. All prices stated exclude copyright use (including commissioned artwork) unless specifically included.

We have the right to revise prices at any time. No price increases will be applied to any items that have been ordered and accepted.

The payment will be deducted in GB Pounds and will be converted to your local currency at the exchange rate on the day of processing. Please check the exchange rate before ordering as fluctuations will mean that the final price may differ from day to day.

Paper prints are individually checked and approved before being carefully wrapped in a cellophane sleeve and then secured inside a strong, large diameter cardboard tube. Postage is included in the price.

Canvas prints (UK only) are individually checked and approved before being carefully wrapped and packaged. UK postage is included in the price. Please enquire for oversees orders.

All oil paintings can be collected, or delivered, by special agreement to suit customer requirements. Shipped oil paintings are carefully wrapped and packaged in a sturdy plywood crate, or similar. All items are sent by insured post so please ensure an address is provided where a signature can be obtained.

Giclée prints are individually produced to order and then signed by the artist, Neil Hipkiss; we aim to despatch prints within 2 weeks of receiving an order. In practice for most orders, it is quicker than that, usually within 1 week. Commissioned pencil drawings and oil paintings take longer to produce and will be delivered by agreement.

If the goods are required for a specific date, then please allow plenty of time when ordering to avoid disappointment. In no event shall we be liable to pay for any damages or penalty for any delay in delivery of the goods however caused.

In the unlikely event that you are not satisfied with the goods you receive, you have the right to return your order within 7 working days of receipt of goods. Providing that we receive the goods in perfect condition in their original packaging and suitable for resale we will be happy to refund you the full cost of the goods returned. The cost of the return postage and insurance will be paid by you. We regret that we cannot accept returns for remarque prints or commissioned original works of art. This returns policy does not affect your statutory rights.

Your delivery is insured so if there are any external indications of damage on receipt it is important that you make a note of this against your signature and inform us within 48 hours of receipt. Goods which are subsequently damaged after receipt, will not be replaced.

Under the United Kingdom's Distance Selling Regulations, you have the right to cancel the contract for the purchase of goods within 7 working days of delivery for none custom-made items. Remarque prints and commissioned original works of art are specifically created at the customer’s request and are exempt from the Cancellation provision of the Regulations. If you wish to cancel a non-custom-made order please notify us by telephone on +44 (0)1886 888 658 or email us at neilhipkiss@btinternet.com. If the goods have been delivered to you, you will be responsible for returning them to us, at your cost, in their original packaging. It is your responsibility to package the goods adequately and safely, as we do not accept liability for packages damaged during transit back to us.

All paintings, images and text remain the copyright of the artist, Neil Hipkiss (including commissioned works, unless specifically included with the commission) and may not be reproduced or transmitted by any means, electronic, mechanical, photocopying or otherwise, for either private or commercial use, without the prior written consent of the artist. Please be aware that the colours and appearance of artwork may vary slightly from the way they appear on the screen. We have made every effort to display colours as accurately as possible on this website, however the colours you see might vary depending on the settings of individual screens and browsers.

While we endeavour to ensure that this Website is normally available 24 hours a day, we will not be liable if, for any reason, this website is unavailable at any time or for any period. Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.

We will use the information provided by you to provide our services to you. We will not disclose your personal information to any other party, unless where we are legally required by law to disclose your personal information.

We will take all reasonable precautions to protect your security and privacy and we will never pass on your personal information to a third party. Online payment is secure through PayPal - we do not see or store your credit card details at any stage of the transaction.

We make every effort to ensure that this website is free from viruses or defects. However, we cannot fully guarantee that your use of this website won't cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and screen out anything that may damage it.

Neil Hipkiss Studio shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

If for any reason part of these terms and conditions is unenforceable; the validity of the remaining terms and conditions shall not be affected.

These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.

We reserve the right to modify, substitute or remove, without notice, any information on this site as necessary.

We reserve the right to change the Terms & Conditions, and post a new version on our website. In this instance the new version will take effect from the time of posting on the site. It is your responsibility to familiarise yourself with the terms and conditions regularly to ensure that you are aware of any changes.

Whilst every effort has been taken to ensure that all the information contained in this website is accurate and up to date, Neil Hipkiss Studio cannot accept any liability to any party for loss incurred by reliance placed on the information contained in this website or through omission or errors, howsoever caused.
